** Caught 3 mos later sleeping in his car. Suspect kept one of his hands down by his side to imply he was armed. In the suspect’s appeal, he argued that the use of the phrase “pull this” is not a threat of death because “it inarticulately implied that he possessed some unknown intention, capacity, or object. The defining quality of the statement, therefore, is that it was too vague to permit any conclusion as to what it meant.” Hmmm.
